What Do Workers’ Comp Benefits Include?
Depending on the severity of your injury, you could be owed different types of benefits. You are required to timely notify your workplace of the incident and the extent of your injuries. Be careful not to give a recorded statement until you speak with us.
Keep in mind, when it comes to medical bills, there are several things to be aware of:
- You must go through the health care professional your employer selects (In Missouri)
- If you want to see your regular doctor, you may be required to pay out-of-pocket or use your own health insurance.
In addition to medical bills, you may be taking a significant time off of work while you recover. Your employer owes you for this time but frequently will not compensate you fairly without a lawyer helping you.
- You are entitled to two thirds of your paycheck up to the state max rate so say max rate (Mark Cantor made this case law in 2012 in a case called T.H. vs Sonic drive through – where a woman was raped at work)
- These payments will only begin once the employees has missed three consecutive days of work, but they owe it back after 2 weeks.
Finally, most work injuries result in some degree of permanent partial disability. If the injured individual sustained a catastrophic injury that resulted in a loss of limb, traumatic brain injury, loss of vision or hearing, paralysis, or any other permanent condition, you are entitled to a lump sum or weekly payments. In this situation, it is your employer’s doctor who decides the treatment your receive and then issues a biased opinion as to the severity of the injury because they work for the insurance company and employer, so Cantor Injury Law will send you to one of our doctors to level the playing field.
